TERMS AND CONDITIONS FOR THE USE OF USER-GENERATED CONTENT
For the purposes of the following terms and conditions, it shall be understood as:
Amstar DMC: includes "Apple Leisure Group", its parent company, subsidiaries, affiliates, subsidiaries, successors, licensees, stock holders, and assigns.
Content: All audiovisual material, photography, video, voice audios, sound, sound effects, printed or digital images, gifs, and any other derivative, any of which may also contain User’s likeness and/or the likeness of persons for whom User is the legal guardian.
Consent/Authorization: Manifestation of the will by which the user accepts to share its content.
User (or “I”): The person over 18+ who grants consent to Amstar DMC for the use of his/her content on Amstar DMC’s website.

By responding #YesAmstar (or any other positive response), User hereby accepts these terms and conditions, and grants consent to share the “Content”, with Amstar DMC (in all its locations worldwide (including but not limited to): Mexico (Caribbean and Pacific), Costa Rica, Hawaii, Jamaica, and the Dominican Republic).
User agrees that I am over 18 years of age, and I am the author of the “Content”, so I have the necessary ownership, rights, licenses, and permission of the “Content”, and that the same does not infringe the principle of originality, privacy or confidentiality, or copyright or industrial property rights, third party rights, economic or moral rights, or any other subject to the protection of industrial property, therefore, I fully agree to grant Amstar DMC perpetual authorization to use and modify the Content, for any publication for any purpose, including commercial purposes, without expectation of payment or compensation, and I also agree that Amstar DMC has no obligation to use the Content or attribute the Content to the User, and I waive the right to inspect or approve the Content published by Amstar DMC on its "Web Site".
In the event that the "Content" violates any of the above, I agree to defend, hold harmless and indemnify AMSTAR DMC from any liability, damage, claim, or cause of action (including legal fees and costs incurred) related to any breach of these Terms and Conditions.
The "User" authorizes AMSTAR DMC the absolute and perpetual right and international copyright permission to transmit, publish, reproduce, distribute, publicly display, exploit, create derivative works, market, and export the Content and permit AMSTAR DMC to make partial or complete modifications, alterations of color, sounds, compositions to the Content that are necessary to be used in any media in any format and by any means, whether printed, digital, known or to be known, including but not limited to art, advertising, commerce, or promotional campaigns in order to advertise the services of AMSTAR DMC.
I have read these Terms & Conditions prior to giving permission for the use of my content, therefore, I fully understand the content, meaning, and impact of this Agreement.

TÉRMINOS Y CONDICIONES PARA EL USO DE CONTENIDO GENERADO POR EL USUARIO
Para efecto de los siguientes términos y condiciones, se entenderá como:
Amstar DMC: las sociedades de Apple Leisure Group”, incluyendo su sociedad matriz, subsidiarias, afiliadas, sucesores, licenciatarios, accionistas y cesionarios.
Contenido: Todo material audiovisual, de fotografía, video, audios de voz, sonido, efectos de sonido, imágenes impresas o digitales, gifs, y cualquier otro derivado, incluido cualquier imagen o retrato del Usuario, y o imagen o retrato de las personas de las que el Usuario es tutor legal.
Consentimiento/Autorización: Manifestación de la voluntad mediante la cual, el usuario acepta compartir su contenido.
Usuario (o “Yo”): Es la persona mayor de 18+ que otorga su consentimiento a Amstar DMC para el uso de su contenido en el sitio web de Amstar DMC.

Al responder #YesAmstar (o cualquier otra respuesta positiva) el Usuario acepta estos términos y condiciones, concede su consentimiento para compartir el “Contenido”, con Amstar DMC (en todas sus ubicaciones en el mundo:, incluyendo sin limitación: México (Caribe y Pacífico), Costa Rica, Hawaii, Jamaica y República Dominicana.
El Usuario acepta que es mayor de 18 años, y es el autor del “Contenido”, por lo que tiene la propiedad, los derechos, las licencias y el permiso necesario del “Contenido”, y que el mismo no infringe el principio de originalidad, privacidad ni confidencialidad, ni derechos de autor o de propiedad industrial, derechos de terceros, derechos patrimoniales ni morales, ni cualquier otro sujeto a protección de propiedad industrial, por lo que, estoy totalmente de acuerdo en otorgar autorización perpetua a “AMSTAR DMC” el uso y modificación del Contenido, para cualquier propósito, incluyendo publicaciones con fines comerciales, sin expectativa de pago o compensación, así también acepto y estoy de acuerdo que AMSTAR DMC no tiene obligación alguna de usar el Contenido o atribuir el Contenido del Usuario y que renuncio al derecho de inspeccionar o aprobar el Contenido que publique AMSTAR DMC en su “Sitio Web”.
En caso de que el “Contenido” infrinja algo de lo señalado en el párrafo anterior, me obligo a defender, eximir e indemnizar a AMSTAR DMC de cualquier responsabilidad, daño, reclamo o causa de acción (incluidos los honorarios y costos legales generados) relacionados con cualquier incumplimiento a estos Términos y Condiciones.
El “Usuario” autoriza a AMSTAR DMC el absoluto y perpetuo derecho y el permiso internacional para derechos de autor para transmitir, publicar, reproducir, distribuir, exhibir públicamente, explotar, crear, trabajos derivados, comercializar, y exportar el Contenido y permitir que AMSTAR DMC haga parcial o totalmente modificaciones, alteraciones de color, sonidos y composiciones al Contenido que resulten necesarios para ser utilizado en cualquier formato ya sea impreso, digital, conocido o por conocer, incluyendo pero sin limitación para el arte, publicidad, comercio, campañas promocionales con el fin de publicitar los servicios de AMSTAR DMC.
He leído estos Términos y Condiciones antes de dar autorización para el uso de mi contenido, por lo que, entiendo completamente el contenido, el significado y el impacto de este Acuerdo.
